Dispute Resolution

  • Commercial Administration of Disputes
  • Advice on resolution of disputes and recovery methods available i.e. Cause & Effect Analysis and Time Displacement/Impact Analysis
  • Advice on the Housing Grants, Construction and Regeneration Act i.e. the Construction Act and Adjudication
  • Independent Legal Advice on the application of Alternative Dispute Resolution
ADJUDICATION provides a "fast track" response to disputes arising under written construction contracts, and requires an adjudicator to provide a decision within twenty-eight days of the referral of such adjudication, or such longer period as is agreed by the parties after the dispute has been referred. Also, the adjudicator's decision has temporary effect until the dispute is finally determined by the legal proceedings, arbitration or by agreement of the parties.

Whittingham Associates can advise on the appropriate methods available to resolve dispute issues and, where necessary, can provide the services of independent and specialist consultants, expert witness' and construction lawyers.
